This website is operated by Gnawnu Inc. Throughout the site, "we", "us" and "our" refer to Gnawnu Inc. By visiting our site or buying from us, you engage in our Service and agree to these Terms of Service. If you don't agree, please don't use this website.

Online store terms

By agreeing to these terms you confirm you are at least the age of majority in your province, state or territory of residence. You may not use our products for any illegal or unauthorised purpose.

Products, intended use and safety

Our products are dog toys intended for supervised play only. They are not chew-proof, they are not indestructible, they are consumable items with a finite life, and they are not intended to be left with an unsupervised dog.

You are responsible for selecting a product appropriate to your dog's size, age, breed and chewing style, for supervising all play, for inspecting the toy before each use, and for removing and discarding any toy that has been torn open or has loose or detached pieces.

To the fullest extent permitted by law, Gnawnu Inc. is not liable for any injury, illness, choking, intestinal obstruction, veterinary expense, property damage or other harm arising from use of our products, including from misuse, unsupervised use, use by an animal other than a dog, use by multiple dogs, or continued use of a worn or damaged toy. If you are unsure whether a product suits your dog, consult your veterinarian before purchase.

We've made every effort to display product colours accurately, but we can't guarantee your screen displays them correctly.

We reserve the right to limit quantities, discontinue any product, and refuse service to anyone at any time.

Assumption of risk

You understand and accept that dog toys carry inherent risks, including the risk that a dog may tear, dismantle, ingest or choke on part of a toy, or suffer an intestinal obstruction. By purchasing from us you accept those risks, and you agree that you are solely responsible for supervising your dog, for inspecting the toy, and for judging whether a product is suitable for your particular animal.

Copyrights and trademarks

All content and materials available on gnawnu.com — including but not limited to text, graphics, photography, video, code, page layout, product designs, the website name, and the Gnawnu name and logo — are the intellectual property of Gnawnu Inc. and are protected by applicable copyright and trademark law.

Any inappropriate use, including but not limited to the reproduction, distribution, display, modification or transmission of any content on this site, is strictly prohibited unless specifically authorised by Gnawnu Inc. in writing.

Changes to products, prices and the Service

We may modify, suspend or discontinue any product, price, or any part of the Service at any time and without notice. We are not liable to you or to any third party for doing so.

Pricing and accuracy

Prices are subject to change without notice. We reserve the right to refuse or cancel any order placed at an incorrect price, including where a pricing or description error has occurred. If we cancel after payment, we'll issue a full refund.

We are not responsible if information on this site isn't accurate, complete or current. Any reliance on it is at your own risk.

Your account information

You agree to provide current, complete and accurate purchase and account information so we can complete your transactions and contact you.

Email marketing

If you opt in, we'll send you marketing emails about drops, restocks, and offers. You can unsubscribe at any time using the link in any marketing email. We'll still send you transactional messages about orders you've actually placed — confirmations, shipping notifications and the like — as these aren't marketing.

SMS and text message marketing

The Gnawnu mobile message service (the "Service") is operated by Gnawnu Inc.

By providing your mobile number and opting in, you agree to receive recurring automated marketing text messages from Gnawnu Inc. at that number, including messages sent using an automatic telephone dialing system. Consent is not a condition of any purchase, and you do not need to sign up in order to buy anything from us. Your participation is entirely voluntary.

Message frequency varies. Message and data rates may apply — we don't charge for the Service, but your wireless provider may. You are responsible for all charges from your carrier.

Reply STOP to any message to cancel, or HELP for help. After you text STOP you'll receive a single confirmation message and then no further marketing messages. If you have opted in to more than one of our programs, you may need to opt out of each separately.

We may modify or cancel the Service or any of its features at any time without notice. We may change the number or short code we use, and we won't be responsible for messages sent to a number we've changed.

Wireless carriers are not liable for delayed or undelivered messages. You agree to provide a valid mobile number and to tell us if it changes. To the extent permitted by law, we're not liable for failed, delayed or misdirected messages, for errors in them, or for any action you take or don't take in reliance on them.

Third-party tools and links

We may provide access to third-party tools and links we don't control. Use of optional tools is at your own risk. We're not responsible for the content or policies of linked sites.

Your submissions

If you send us ideas, suggestions or other materials, whether requested or not, we may use, edit, copy, publish and distribute them without restriction and without compensating you. You agree your submissions won't violate anyone's rights or contain unlawful or obscene material.

Prohibited uses

You may not use this site for any unlawful purpose, to infringe intellectual property, to harass or discriminate, to submit false information, to upload viruses or malicious code, to collect others' personal information, to spam or scrape, or to interfere with the site's security features.

Disclaimer and limitation of liability

We don't guarantee your use of the Service will be uninterrupted, timely, secure or error-free, that any information obtained through it will be accurate or reliable, or that any defect in its operation will be corrected.

UNLESS OTHERWISE EXPRESSLY STATED, GNAWNU INC. DISCLAIMS ALL WARRANTIES AND CONDITIONS OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES AND CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, AND NON-INFRINGEMENT. THE SERVICE AND ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE", EXCEPT WHERE APPLICABLE LAW DOES NOT PERMIT SUCH EXCLUSIONS.

No information or advice, whether express, implied, oral or written, obtained by you from Gnawnu Inc. or through the Service, creates any warranty, guarantee or condition of any kind beyond those expressly set out in these terms.

To the fullest extent permitted by law, Gnawnu Inc., its directors, officers, employees and suppliers shall not be liable for any indirect, incidental, punitive, special or consequential damages arising from your use of the Service or any products bought through it. In all cases, our total aggregate liability to you is limited to the amount you actually paid for the product giving rise to the claim. Where a jurisdiction doesn't allow such limitations, our liability is limited to the maximum extent permitted by law.

Indemnification

You agree to indemnify and hold harmless Gnawnu Inc. and its affiliates from any claim or demand, including reasonable legal fees, made by a third party due to your breach of these terms or your violation of any law or third-party right.

Dispute resolution

To the fullest extent permitted by applicable law, any dispute arising out of or relating to these terms, our products, or your use of this site shall be resolved by binding individual arbitration rather than in court, and you and Gnawnu Inc. each waive any right to a jury trial and any right to bring or participate in a class, collective or representative proceeding.

This section does not apply where the law does not permit it. In particular, if you are a consumer resident in Ontario, Quebec, Alberta, or any other jurisdiction whose consumer protection legislation restricts arbitration clauses or class action waivers, nothing in this section limits any right you have under that legislation to commence or participate in a court proceeding, including a class proceeding.

Before starting any formal proceeding, please email info@gnawnu.com so we have a chance to resolve the matter directly. Most things can be sorted this way.

Termination

These terms remain in effect unless and until terminated by either of us. You may terminate at any time by ceasing to use the site. We may terminate at any time, and may withdraw access to the site, if we believe you have breached these terms.

Force majeure

We are not liable for any delay or failure to perform caused by events beyond our reasonable control, including carrier and postal delays, customs inspections or holds, extreme weather, labour disputes, supply chain disruption, or acts of government.

Entire agreement and no waiver

Our failure to exercise or enforce any right or provision of these terms does not constitute a waiver of that right or provision. These Terms of Service, together with the other policies published on this site, constitute the entire agreement between us and supersede any prior agreements or understandings.

Severability

If any provision is found unlawful or unenforceable, it shall be severed and shall not affect the validity and enforceability of the remaining provisions.

Governing law

This website is operated by Gnawnu Inc. from Ontario, Canada, and can be accessed from most countries. As each country has laws that may differ from those of Ontario, by accessing this website you agree that the laws of the Province of Ontario and the federal laws of Canada applicable therein — without regard to conflict of law principles and excluding the United Nations Convention on Contracts for the International Sale of Goods — apply to all matters relating to your use of this website and the purchase of any products through it.

Any action to enforce these terms shall be brought in the courts located in the Province of Ontario, Canada. You agree to submit to the personal jurisdiction of those courts and waive any objection based on venue or inconvenient forum.

Nothing in this clause deprives a consumer of the protection of mandatory rules of law in their country or province of residence.

You can review the current version of these terms on this page at any time. We may update them by posting changes to this website. Continued use after changes are posted means you accept them.
